A settlement agreement is a legally binding contract which brings the employment to an end on terms agreed by both parties, most commonly used in cases of redundancy or performance.
Following a settlement agreement being reached, the employee whose employment has been terminated can then no longer issue a claim in the Employment Tribunal about the issue. In order for a settlement agreement to be legally binding, independent advice must be sought by the employee before signing.
