After contacting us with what on the face was a straight forward road traffic accident claim the defendant turned out to be uninsured and the claim had to proceed through the Motor Insurers Bureau (MIB). (The MIB is an organisation that look under their relevant schemes whether they can compensate victims of accidents caused by uninsured and untraced drivers).

Despite the circumstances being a straight forward rear end collision the MIB then did not accept liability. To complicate matters further the MIB then questioned the claim brought for injury and repairs by the Claimant.

As the livelihood of the Claimant depended on being able to drive and in no doubt going to be affected by this accident court proceedings were issued against the MIB and after a lot of enquiries made on behalf of the Claimant and with their co-operation the claim was accepted by the MIB. The Claimant was appropriately compensated and their insurance not affected by the accident.

At a time were the government are trying to make significant changes that will prevent access to justice it is important to note that the successful outcome of cases like this will become difficult if not impossible without the assistance of a hard working legal team.
