Her ex partner had also been physically violent previously and made threats against her family’s property where she was living to try and get away from him.
The mother had contacted the police however they were unable to prosecute her ex partner and so no protective measures were in place for her and she felt vulnerable and unable to return safely to the family home with the children. We were very quickly able to get the mother in to see us to provide her with robust advice on her options within the Family Court on applying for a Non Molestation Order for protection. Within 24 hours of seeing the client we were able take her full instructions to prepare a legal aid and Court application and took the matter to Court to obtain a without notice Order to protect her. This enabled the mother to return safely to her home with her children.
Hattons, Chartered Legal Executive says ” I understand that it is often very hard for victims of domestic abuse to come forward. We are able to act quickly to help put protective measures in place to help reduce the worry and anxiety and also assist with referring victims on to other organisations and support services for ongoing support once the legal process has ended. Legal aid is available for representation within these type of proceedings we just need to check financial eligibility to see whether any contribution may be payable.”
