All package tour operators in the UK have to follow the Package Travel, Package Holiday and Package Tour Regulations 1992 so they are liable to pay you compensation if you are involved in a holiday accident abroad and injured as a result of somebody else’s negligence.
A package holiday is a pre-arranged trip including at least two of the following elements at an inclusive price: Transport, Accommodation and any other tourist services such as excursions or guided tours. The holiday must be over 24 hours and include an overnight stay.
Unfortunately many holidays booked over the internet will fall outside the definition of a package holiday so if you are involved on a holiday accident you may not be able to make a compensation claim under the regulations. If in doubt, please get in touch with Hattons so we can advise you of your rights.
Common holiday accidents include:
Holiday accidents could also happen on board a plane that is taking you to or from your destination, or even in the airport lounge during the transit itself.
Some people also suffer holiday accidents in the UK. If you suffer an injury due to the negligence of somebody else then you may be entitled to claim compensation.
It is a good idea to ensure that you collect as much evidence as possible at the time if you are involved in a holiday accident, as you may be some distance from home, making it difficult to return to take photographs or witness information at a later date. Where possible, you should also ensure that the details of the incident are recorded in an accident book.
Personal injury claims for accidents occurring on holiday in the UK can be dealt with in the normal way through the UK courts.
