Do you know your legal rights when it comes to taking care of your step children?
At Hattons we often find that step-parents do not know their rights and this can become an issue especially in emergency situations. If a child requires medical treatment or the authorities wish to question a child they will often need to deal with someone with parental responsibility.
Even if a step-parent is married to a parent of children, this does not mean they automatically acquire parental responsibility.
However step-parents can acquire parental responsibility through signing a parental responsibility agreement to which all parents with PR have signed.
This is a formal document which needs to be completed by the parties and then registered at court. It entitles the step-parent to the same rights and responsibilities as a natural birth parent with parental responsibility.
As in all cases concerning a child, the court will base its decision on what is in the best interests of the child.
It is important for other parents not to worry as the acquisition of parental responsibility by a step-parent does not affect the rights and responsibilities of the other parents with parental responsibility.
At Hattons Solicitors we pride ourselves on our expertise and experience, helping protect step-parents’ rights.
Our clients can benefit from our convenient online file view system which allows them to see the progress of their case whenever they need to.
