Parental Responsibility Orders are used to ensure that both a mother and a father are kept involved with important decisions about their child’s life, from schooling to medical treatment. They can also cover child support and maintenance.

Unless a mother and a father are married a father does not have automatic Parental Responsibility, but this can be obtained. To ensure the best for your child call our family law solicitors on 0800 298 9690 or use our online form to request a call back.

Your current legal position

If you are or were married to your partner then you will already have Parental Responsibility. This means you have a right to be kept informed about your children’s education, health and general welfare, and you can contribute to decisions about these issues.

However, if you are a father but you are not married to your partner and the children are not living with you then you may not have the right to make important decisions concerning the children.
You may not need to go to court in order to get Parental Responsibility. If you and your partner agree then you can enter into a Parental Responsibility Agreement, which is a type of contract.

If any of the following apply to you, you already have Parental Responsibility:

Other considerations

Parents who have Parental Responsibility, and the legal rights which come with it, should bear in mind that contact with a child is a separate matter. Our contact orders team can help with this.

Could mediation help?

In some situations conflict can be resolved using mediation, and this is a welcome outcome for many couples. Deb Choudhuri is a family law solicitor and accredited panel specialist, as well as a member of Resolution and The Law Society, and can provide mediation sessions if requested.
